Property Ombudsman (Case 21361) 3 of 5 complaints upheld, plus concern expressed regarding practice for a fourth complaint and compensation awarded accordingly. The following quotes are the findings of the Ombudsman.
1. Market Appraisal: "I do not consider that the approach taken here by GG to establish an appropriate asking price provides a sufficient explanation for the sum they initially recommended of £780,000 and then subsequently marketed at £750,000. They have not therefore met the requirements of Paragraph 4a of the Code as they should have conducted research into other sold properties nearer to the Property’s specifications";
2. Viewings and Feedback: "Whilst there are a record of some of the feedback being conveyed by email, the majority appeared to be conveyed by telephone. There is no record of this within GG’s file and so there is insufficient evidence to support their claim that all feedback conveyed via this method was initiated by them. As such, I will support this complaint to that extent and make an award of compensation" In fact it mostly relied upon us to continually chasing for feedback and;
3. Offers "GG’s communication was somewhat lacking here and they could have been more proactive in terms of explaining the circumstances of the buyer sooner. This would have allowed the Complainants to be in receipt of all facts. GG should have also, in my view, provided an update (even if to just say they had not heard anything further) when the Complainants were expecting to receive this and responded sooner than they did to the update request from the Complainant. I recognise therefore that some aggravation has been caused here which merits an award";
4. Security of Keys - not sufficient evidence for judgement, however when viewing the CCTV footage the ombudsman wrote: “I note the evidence of the video recording and can of course recognise your concern.”
We wouldn't give one star but unfortunately a review with no stars is not possible.
