We finally bought this property for my aged father in law, but only by by-passing the agent who was being exceptionally unhelpful in our efforts to make offers. He told us that an offer had already been accepted and that the mortgage survey was being done. He said that he could only act in the best interests of the vendor. His behaviour was obsequious and I didn't trust him. I contacted the vendor direct and spoke with him, and it was quite clear from my conversation with him, that what David, the agent, was telling was untrue. In the end we purchased the property for cash in a contract race, which was only initiated because of my direct contact with the vendor who gave permission for me to speak to his solicitor. The vendor was angry with the agent, because he charged his fee as a percentage of the final sale price, which was more than the offer that he had passed to the vendor. I only discovered this after the sale.
I have been very suspicious, and discovered that he was probably going to receive some form of payment as a result of the property being sold with a mortgage. I went in to speak with David today, as he was at his desk. He flatly denied that there had been a mortgage involved with the other prospective buyer. I was absolutely astonished. This was a bald faced lie, and if not, then he had definitely lied at the time of the sale.
Such behaviour should be subject of disciplinary procedures.
What agent could do to change your mind?
Told the truth and not lied to promote his personal best interests and not those of the vendor,
