Dangerous * business practice is the standard with this letting agent.
First of all Laura Ross the 'move in coordinator' charged us over £155 in illegal fees - she first of all denied doing this and then when we were able to provide evidence via bank statements she now completely refuses to address the matter or return them to us even though we have the evidence of the transactions, we were also told the flat would be deep cleaned prior to moving in, the flat was filthy and we were not provided with an inventory of the flats contents, probably because half the furniture/fixtures and white goods are/were broken prior to us moving in and the landlord uses it to scam the deposit. Laura also denied we informed them we had cats, even though she charged us a fee for having them, she continued to deny we had informed her of the pets prior to moving in or signing the lease and used it as an excuse to say we had broken the tenancy agreement by having pets in the flat (even though the landlord and CR have broken their own lease multiple times over) she continued to claim this until I provided the first email I had sent to CR explaining I had pets, nothing was mentioned of it again nor were we given an apology for Laura lying/forgetting/misrepresenting the facts.
There are no gas or electricity safety certificates and we were consistently lied to and fobbed off when we requested to see them, again Laura Ross requested we sign the lease and she would get them to us within the week, this never happened, luckily I have written confirmation from Laura admitting she done this and the reason they couldn't provide them is because they never received them from the landlord, which they should have had in their possession before they even agreed to managing the property for her. Castle Residential and Laura knew they didn't have these certs which means the property should have never been rented out without them being in their possession and being up-to date and to do so is illegal as having up to date gas and electrical safety certificates is a legal requirement with rented properties to not have them is to put tenants lives at risk and shows how little they regard their tenants safety, we got nowhere trying to sort it out ourselves and we were passed onto to Jack Morrison who proceeded to deal with the situation by harassing/railroading/lying to and about us for simply requesting we be provided with the certificates and repairs be seen to, we obviously got nowhere dealing with him/them ourselves for the first two and half months so we joined a great tenants union (LivingRent) and we had to resort to getting environmental health involved who put a closing order on the property that's when things got really bad and CR (in cahoots with the landlord Marilena Vassalos) sunk to new lows, instead of admitting they had no up to date safety certificates what they decided to do was get an engineer to fraudulently provide one, I realised it was fraudulent because it claimed things (carbon monoxide detector) was a pass when they simply weren't even in the right room to pass, also the company - all cisterns go, Johnstone - they used went solvent on 07/08/15 and the engineer wasn't even qualified to check/pass some of the appliances which was highlighted by the environmental health officer, who reported the engineer for this and I also contacted the police as I had recorded him admitting he was hired by CR and lied/provided the fraudulent gas cert under the direction of them and the landlady who he spoke to in person, I should also mention here that we were never asked if he could get access to the property or even aware he was in or had been in the property as CR and the landlord failed to inform us, again breaking the tenancy agreement. Castle residential once again have failed to address it and think sending out a qualified engineer to now do the gas safety cert absolves them for not having one for the property for the four months we have been there and for fraudulently providing one - literally no shame.
The flat also had extensive dry rot that was covered up and not disclosed prior to us moving in, we notified the letting agent and landlord soon as we were aware which was after two nights of being in the property and mushrooms started sprouting from the walls 12/06/17 who failed to do anything about it for the first 3 months of me being in the property and notifying them, to the point I had to contact a dampness surveyor myself who they had claimed to have contacted (I got confirmation this was not the case by the company) and organised a survey myself, they refused to release the report and only agreed to the works being carried once the closing order was put on the flat, the work was completed two weeks ago, all the floors in the kitchen, bedroom and hallway had to be ripped out, half the walls removed and replaced and multiple pieces of furniture had to be thrown out by the contractors because of the extent of the dry rot, it took over a week for the work to be carried out, we had to stay in the property as it was getting carried out as CR and the landlord refused to provide alternative accommodation. We have been couch surfing pretty much since and I've had to pay for someone to care for my cats in the meantime as even though the work for the dry rot has been completed we have no kitchen whatsoever as all appliances had been removed/disconnected and we haven't had access to one since 21/08/17 when the surveyor alerted us that we shouldn't be in the room never-mind prepare food in it, even before that we didn't have access to an oven/grill as it was broken prior to us moving in, the landlord was aware of this and chose to ignore it and then lied about it saying it was just an issue with the timer... luckily (again) we have written evidence of this.
All the windows have been locked shut by the landlord, who didn't disclose that you needed a key to open them nor has she provided a key to do so, even though we have been requesting for the windows to open for duration of the time we have been there, we weren't even aware you needed a key until she provided one to the contractors seeing to the damp.
Jack Morrison emailed us on 06/08/17 to say that removals for the work needing done would have to happen that night between 8-9pm, we had provided times we would be available that day two days prior which was anytime up until 8pm except between 3pm and 4pm, he chose to ignore this and told us if we couldn't accommodate then they would go a head and gain entry to the property without our permission (even though our tenancy agreement clearly states 24 hours notice must be given, he gave less than 8 hours notice while knowing it wouldn't be possible for us to accommodate or for removals to even be carried out at that time - we live in a basement flat, the driveway is basically a mudslide as the landlord refuses to maintain it and it was also completely dark outside with noway to light it and it would take hours to complete the removals even in daylight. When we refused this time and requested an alternative time between before 3pm or between 5-7pm he refused and he did indeed stick to his word and sent four males to gain entry to our flat at 20:40, although they tried to gain entry (without knocking) to my neighbours flat instead of ours (they didn't even know which flat to go to) they then attempted to gain entry to our flat with such force that they knocked my keys out the front and back door, I was home alone and contacted the police who arrived after they left and I have two incident numbers from the night. At 21:20 after the police had left and my partner returned from work (he left early as I was so shaken) a further two males/thugs different from the first four and again sent by Jack tried to gain access to the property again without knocking or declaring who they were, this time as I was no longer alone, I opened the door as they were attempting access and confronted them, they tried to force their way past me until they realised I wasn't alone and I yelled for my partner to call the police again, upon hearing me say 'police' they ran away from the property yelling 'she's phoned the polis Jamie' (why would you run if you weren't doing anything illegal?) this time I chased after them (adrenaline I guess) and was able to get a picture of the registration plate and removal van which was vw Jetta car, the literally couldn't have used it to remove anything in the property - it was just another scare tactic (one of numerous Jack has tried to use on us).
I could go on and on and on about the hell this 'letting agent' has put us through and how many times they have put us at risk, but just be smart and never, ever, ever use these double-dealing fraudsters. They are morally bankrupt and their so called business practices are illegal and dangerous and that's putting it mildly.
We simply want to end our lease, have all rent paid returned to us as it was obtained illegally and the flat hasn't been habitable, illegal fees obtained by Laura Ross returned to us and our deposit back and hopefully never have to deal with these thugs again of course they aren't allowing this or addressing my request, the also refuse me my right to an advocate from living rent being present for any meetings to try and resolve the matter and when they also have failed to allow me to have an MSP who is willing to be advocate as well. We've lost earnings through this trauma, I've been put on anti-anxiety medication, it's impacted my partners studies and attendance on his course, we had to throw out all food we had in our kitchen as it we had nowhere to store it and it was unusable and so many of our belongings were damaged through dry rot that we had to just admit defeat and throw them away, again I could go on and on. Castle residential simply could not care less about their tenants. Rent for the death trap is £835 pm.
