They took our case to court we just paid as i don't want a ccj as our credit rating is very good but their terms are miss selling and miss leading , now its cleared i will be suing them and getting a refund

very similar experience. I checked with staff that I didn't owe anything as I handed over my withdrawal letter and they confirmed that I did not. I was aware of the 'reserve the right to charge' clause which is why I checked in branch. A week after they started hounding me for £180 and I have finally given in when threatened with court action. The company bullies people into submission and the branch staff have very selective memories. I will do everything and everything to discredit this company.

Hi Ribbons 473, just logged in to this site for the first time in ages, Mo Jarvis rang me up on my holiday demanding money off me, I'm not paying and made that very clear. I'm going to let anyone and everyone know about the bullying tactics of Spicerhaart if they carry on with this. it's been going on for15 months! Let them know that you cannot make the court date. These people have no thought either for the untold stress that they are putting on people. It said on their web site "We will only charge if you move.If for any reason your sale or purchase falls through, we will not charge you anything for our time" another thing they have written on their paper work in 1cm font is "WE'RE HERE TO HELP" and " WE'RE ON YOUR SIDE" The marketing fee I think you'll agree, is in much smaller font and no-one seems to mention it. Sorry if you've paid it and its not caused you too much worry.

I too have been fighting for nearly a year with them over this fee, our house was only on the market with them for 8 days and they still charge this. It may be in the contract but I would suggest that maybe you leave the contract with the customer to read at their own leisure rather than harrassing them to sign it there and then. It is also imperative that any fees are clearly and verbally pointed out so that claims of mis-selling are avoided. 2 days ago I was told their final judgement was that the fee is valid and must be paid, however I could go to the property ombudsmen however I must pay the fee first?? I have then today received a letter informing me that they intend to take me to court. Any advice??

Hello Customer Relations Manager. I beg to differ with you on this matter, I am clearly not alone in thinking that your £150 +£30 vat fee is not clearly indicated on the front of the agreement, it is in fact hidden so well, quite a lot of fairly intelligent people have failed to see it, and I thought in this day and age of miss selling, charges should by law be bought to the customers attention. Also why have you discontinued the Fee? and as you have discontinued the fee are you still expecting your ex customers to pay it?

Hi there. The Fee is clearly indicated on the front of the agreement which you would have read before signing. Since you signed, however, we have discontinued the Fee so our new agreements will not have this on there. Therefore, you may well have seen no sale no fee as this is now correct. I feel Ripped off by Spicerhaart too. In the presence of my sisters on one occasion an agent from spicer mcoll came to our house in October 2010 and never once mentioned the £150 +£30 vat marketing fee and then Haart came round as their sister company and spoke to me and my husband and the same thing happened again. So it 's 4 witnesses to 2 estate agents. I've sent them lots of letters and emails explaining this and the fact that if I'd known I'd have to pay out £180 I would NEVER have used Spicer Haart as there are plenty of other estate agents who only charge commission. Also in some of the correspondence I've sent to the various people who send me things about this matter, including the threatening letters( God help any pensioners ! ) I incuded a print out from the Spicerhaart that states no sale no fee! I Just find the whole thing unbelievable and feel like knocking on any door I see with one of their boards up and asking the people if they know about the fee.

Mainly due to being tricked by your low life lying sales staff and mangers who hide the fact that if you fail to spot the seperate unmentioned small print o the back of the contract within 7 days of signing you will be forced into paying £180.00.
Is this part of the Haart staff training.
