Placed house on market December 2012 then took off market (initially temporarily) in February 2013 after receiving no viewers. Heard nothing from the agent until a letter in October 2013 referring to an invoice dated December 2012, saying no payment had been received (despite the fact it had never been asked for until this point. I was well aware it was due to be paid on either the property being removed from the market or sold) and if payment was not received within 14 days interest would be charged on a daily basis of 3% before steps were taken to recover the monies owed. I documented my experience in a letter following a telephone conversation I had with the member of staff in question the day the letter arrived. Wouldn't use them again both because of my experience and similar experiences two friends have had of A&H. Please see below.
Dear XXXXX,
As requested in your letter dated October 24 2013 please find enclosed a cheque for £390. I would like to place on record that whilst I am sending the requested sum I am doing so feeling not entirely content with the service received.
Having placed the property on the market last December not a single viewer was received in near on two months. I realise the period of year the property went on the market was not the best for sales and undoubtedly played a part in this. However having had no viewers, I actually got a friend to call your branch in January to enquire about the property. When he did so he was told details of another property in the same street which was also for sale with you. When he explained it was my property he was interested in and then asked what the differences were between both properties he was not given any great detail. Importantly at no point was he offered a viewing either.
The reason why we decided to then suspend having viewing was down to a private matter. However there has been no recent communication to enquire what the current situation is and whether it was time for the property to be put back on the market. Hence my surprise in receiving your letter last week. Furthermore, as explained to you in my telephone call last Friday, I was also taken aback by the tone and confused by the complete lack of clarity of the content within the letter. The latter was confirmed when you first told me you hadn't seen the letter before it had been sent out (as it had been written by someone else then signed on your behalf) then said interest would not be charged on a daily basis of three percent if payment was outstanding for more than 14 days (completely contradicting the direct and specific statement within the letter). When I suggested to you last week that it might be helpful if the letter was changed in similar scenarios in the future I was bluntly told it was a standard letter which could not be changed. It seemed strange to me that if it was a standard letter that you did not know the content despite your name being on it. If, as you say, the letter cannot be changed then I would have thought you might have at least said you would refer my feedback to Allen & Harris' HQ rather than treating it with contempt and dismissing it out of hand in the way you did.
I hope you can understand why your letter last week summed up the poor experience had dealing with Allen & Harris. In the interests of transparency from my side of things I would just like to add that once my cheque has been cashed I will be placing this account on publicly viewable online estate agents review websites including www.allagents.co.uk and www.agentright.com as well as property forums I am on.
