We found the davies and davies service as tenants/property managements average. The reason for the score not being higher is that on exiting the property they attempted to charge us for cleaning despite the property having been cleaned. To make the demand more contentious, the property had actually been sold to a new owner by the time the deposit discussions had started! This meant that no cleaning company was going to be brought in and the new owners would receive our money (they even told us this), this is NOT what the deposit scheme is designed for. It even explicitly states that no one can profit from the tenants' deposit, is only to cover costs.
When we negotiated with the agency, they at first reduced the amount in dispute by half. However then when it appeared that we were still not happy they told us to take it to the dispute service but raised the amount in dispute by 4 times the initial amount simply because we wanted to continue to negotiate!
This is not allowed under the dispute service and effectively forced us to back down in order to receive money we desperately needed to cover new deposits. Of course once we had agreed to settle the amount in dispute suddenly became half the original dispute amount again and all other charges were "forgotten" (i.e because they were illegitimate)
We felt we had been betrayed and taken for a ride by this agency and had our money taken for someone else's direct profit. It's disappointing that Tenants do not have more protection from this sort of behaviour.
What agent could do to change your mind?
Deposit negotiations should have been conducted fairly and within the guidelines. If no costs have been incurred by any parties (n.b. parties within the tenancy agreement) then there is no requirement from the deposit.
