1. Request the Agreement: Ask the agency to send the agreement within 15 days after paying a holding deposit, as required by the tenancy act. Do not accept their excuses about delays, THEY WILL USE THEIR DELAY IN SENDING THE AGREEMENT AGAINST YOU AND NOT REFUND THE HOLDING DEPOSIT if anything goes wrong because of them and you end up not moving in.
2. If you have conditions in the offer, state clearly that if those are not met, then they will need to return the holding deposit AS AND WHEN YOU FIND OUT THAT CONDITIONS ARE NOT MET.
Our Experience:
Initially, everything was positive. In May, Bailey Roberts helped us with a property. We made an offer that included repainting work, which they accepted. We paid the holding deposit and passed all background checks. They also asked us to leave a positive review, so that someone the agent we worked with would win their trip to Croatia.
In June, they mentioned the repainting might occur after the move-in date. We asked to specify when exact after move in, we expressed we are not comfortable with uncertain dates as it was part of the offer that they accepted. By July, we still hadn't received the agreement or heard about the timing of repairing work. After several follow-ups, they informed us the repainting would take a year (my entire tenancy was 2 years lol). I refused, and they suggested I handle the repainting myself. This happened just three days before our scheduled move-in date. They agreed to push the date back by two days, but the agreement they sent did not reflect this. Not only did they not keep their part of the deal with repainting, they aLeo expected me to move in the day after they sent me the final agreement to sign, which was impossible. I wasn't going to start paying for the days that I can not move in by.
Now, of course, they are refusing to return my holding deposit. Calls, emails, and messages have gone unanswered. They say they will call back and they never do.
It was a terrible experience, and I lost a week's rent as a holding deposit. However, I'm glad I withdrew. Based on my experience, if something went wrong with the flat, they would probably take a year to fix it and make promises they don't keep. If something goes wrong, even getting a hold of any of them is hard. Every time I call Bailey and his manager YuJin are 'unavailable'
