Not sure if this is ethical or even legal as there's no clear instruction for buyers as if you don't come to an agreement to purchase it with the auction, you as a buyer ...
I can confirm that our position delivered to you in our final formal response remains the same.
The non-refundable Reservation Fee (as well as being clearly advertised in our marketing materials, terms and conditions, buyers guides, and reservation agreements) was discussed with you multiple times before your final offer was accepted.
Leanda helped you sign up to the bid registration over the phone at your request, and clearly stated to you that you must read the Terms and Conditions before proceeding to accept them.
When Leanda called to congratulate on winning the property, she provided our bank details to you as you requested them. You then paid the non-refundable Reservation Fee of our own accord via bank transfer within the next few hours.
It is the Buyer's responsibility to ensure that a property is fit for their chosen funding method, and we cannot uphold any assertion that we forced you to act against your will.
I am sorry to see that you have not had the positive experience that we strive to provide to all of our customers, but I must confirm that our formal response to your concerns remains unchanged.
You are free to pursue The Property Ombudsman if you wish to escalate your concerns further.
