The SELLER withdrew during the reservation period we all agreed to extend (at £1200 a week) and I Am Sold refuse to give us back the reservation fee - £48 000.

Dear Mr Clerc,

I am sorry to see that you are unhappy with the decision to retain the non-refundable reservation fee.

Upon you signing the Reservation Agreement on acceptance of your bid, you are confirming your understanding of the terms and conditions laid therein.

The Reservation Agreement is a legally binding agreement between yourself, and the sellers and it is confirmed under Point 1c. The Reservation Fee is not refundable to the Buyer save only if the Seller withdraws from the sale during the Reservation Period. In all other circumstances the Buyer agrees that the Reservation Fee shall not be repaid to the Buyer.

The Reservation period had ended and the seller was no longer willing to wait for funding as the transaction had gone on for several months and they withdrew.

As confirmed within the fee retain letter issued to you, you are able to appeal the decision and an independent review will be undertaken by a member of Customer Service Team.

Thanks for your reply. But why using viewers names to make money. You cannot force people to pay with out registered on your website or made a bid on properties. You can put these therm on you website for your bidders so they have to agree before that. This is unlawful make this kind of list without this people knowing you have such a contract with vendors. Agency have to inform the viewers about that black list. ...
