We had a buyer and I had an onward purchase set to complete in December. Our buyer wanted to complete in September. The agent said they would not tell the buyer that my completion date was not until December so as not to frighten her off. I thought this was unprofessional and could put her in an awkward position with her rental property and plans and said she should be told. The agent asked me if I would vacate the property early to secure the sale to which I said absolutely not, there was no possible way I could or would do this, it was a very strong and hard NO. My ex husband offered me a reduction in his legal fees payable by me to cover my rent if I moved early however this offer was insultingly pitiful and would not have covered moving costs and even 1 month's rent and deposit, never mind the 3 months required plus associated costs and hassle. I declined the offer and said there was absolutely no chance at all that I would be vacating early but that I would vacate on completion of my onward purchase. The agent then said that in that case our buyer had pulled out of the sale and our chain had collapsed. I tried for a week to contact the agent to discuss remarketing only to be told the agent dealing with it was in meetings or out of the office. I then received the contract to sign from my solicitor. I questioned why I was being asked to sign the contract when the buyer had pulled out only for my ex husband to say she hadn't and that they were intending to complete in 8 working days time and I was expected to leave. I own the house jointly with my ex, I am a single mother with 2 children and am on an extremely low budget, this would have been entirely impossible and caused me and my children huge stress, anxiety and upset. I contacted the agent to ask why the sale was progressing given the situation and why I hadn't been told only to be told it was not their problem. I then spoke to the buyer who said that she knew my ex husband had offered me money to cover my rent, which she could only have known from Bourne. This was a private arrangement which should not have been disclosed to her. My ex husband also had a lot of information about my onward purchase which I had made clear was not to be disclosed to him given his long history of abuse towards me. I cannot prove this came from Bourne but it would have taken a lot of underhand sneaky behaviour for him to find these details out on his own and I would not be surprised if it did indeed come from Bourne. My ex husband also told me that the agent was looking for a suitable place for me to rent and was going to arrange it, without any agreement or participation from me as if I would just be relocated and sent the bill against my will and without my even approving the new place or knowing it was happening. The relationship between the agent and myself has now broken down entirely and communication is no longer possible or desired but their behaviour in this has been appalling. I had to make an urgent application to court for an emergency hearing which has cost me over £1000 I do not have. This should have been a very simple process with clear and timely communication and honesty, and instead has become a living nightmare causing insurmountable stress and upset, significant unnecessary expense and incredible acrimony all around and was entirely avoidable. I do not know what exactly they though they were doing or how this would ever be in any way acceptable behaviour but this needs addressing and potential clients should be warned. Choosing Bourne was a horrible decision I regret entirely.
