Highly dissatisfied with Ullyotts given my own experience. One of Ullyotts directors (Paul Butler) also acts as my Trustee. Ullyotts are now attempting to sell the Trust owned property of which I am a beneficiary using this Directors own firm as the vehicle. It is stated on Ullyotts website under the property details:-
"NOTE 2 The sellers are trustees and one of the trustees is a director of Ullyotts".
Trustees in law owe the beneficiaries (for whom they manage the Trust) a fiduciary duty. One fundamental rule in carrying out that duty is that a Trustee is restricted from obtaining any indirect or incidental profit or gain from their appointment as a Trustee. A Trustee must act within the express terms of the Trust. A Fiduciary is expected to be very loyal to the person to whom he owes this duty, (the Principal) meaning there must be no conflict of duty between the fiduciary and principal. The fiduciary must not profit from their position as a fiduciary UNLESS the principal consents.
Ullyotts marketing this property represents a blatant example a Trustee directly profiting from the Position in Trust held.
The other Trustee (Angus Spencer) has failed to stop this from happening.
Prior to marketing, in an email to the Manager, Bridlington Ullyotts, (Sally McGill) I expressly objected about this property being marketed through Ullyotts, but, my email was completely ignored.
The marketing photographs were so hurriedly uploaded onto Ullyotts website that they didn't even include a picture of the main living room originally. Plus the bathroom picture is still extremely poor. Important oversights considering the internet is used by most potential buyers looking to initially shortlist properties prior to making a decision to view them. This is especially relative given the current Coronavirus pandemic.
I have also expressed my objection with regards to to Ullyotts marketing this property (an objection based on rational sound reasons for seeking a different selling agent) to both Trustees directly, requesting that the Trustees immediately transfer the sale of the property to an alternative agent.
By my own personal experience it would appear that the Ullyotts Director, feels some of his actions as a Trustee are beyond reproach as he has carried on pushing to market this property through his own firm, completely ignoring my concerns as a principal of the Trust.
The lack of professionalism I have experienced from this firm plus the self serving manner to which the Director of this firm chooses to behave is deplorable.
I have offered simple solutions to remedy the situation to hand i.e. using an alternative selling agent, but alas to no avail.
Therefore, from my own personal experience to date I could not recommend Ullyotts.
