I am a first time buyer, I was not very knowledgeable to property and misrepresented by the selected information the agent disclosed to me, as the property was not fit for a mortgage buyer they still let me put down reservation without disclosing that the property is not fit for mortgage buyer.as a result, I lost my reservation fee.

Thank you. First, I won't be paying £1500 reservation fee and wasting nearly 1 year of my time waiting for this property if I knew that this property could be potentially not fit for mortgagees, but I won't be asking question if I wasn't made aware of as a first time buyer, it is your responsibility in disclosing all these issues to me as these are legitimately affecting my decision as a buyer. Please provide evidence could prove that Ektha went through the DoV and the lease having a doubling ground rent clause back in September 2019 when this initial viewing was conducted. Or any evidence that you have doubling ground rent issue mentioned in any marketing information at the beginning.

Ms Li, thank you for this feedback and can I first say that we are sorry to learn of your unhappiness with the service you have received. To address your main point, this property will be mortgageable once the EWS1 form is obtained and the Deed of Variation complete, information which our Sales Manager, Lucy Wakeland has explained to you. The EWS1 form has to be organised by building management which has unfortunately delayed the process; however, we have had confirmation that there is now a survey booked for 6th July 20’ to carry this out. You expressed concerns regarding the lease having a doubling ground rent clause which I would assume makes up part of the non-disclosed information you have referenced, however our sales negotiator, Ektha Mehta, ran through all this with you on the initial viewing. As you were also aware, the vendor is organising the Deed of Variation at his own cost to change this clause bringing ground rent in line with RPI, which explains why our negotiator wouldn’t have thought to spend more time on this point. The vendor has also allowed you to move into the property due to the unavoidable delays in this process, whilst accepting a below market rental to ensure minimal financial impact to yourself. The reservation fee you have paid represents a commitment to completing the sale which is why it makes up part of the purchase price, it’s in place to avoid either party simply changing their mind during the process, resulting in the loss of both time and money. As this property will be mortgageable once we have the EWS1 form, pulling out of the deal at this stage represents a breach in terms, and the reason you haven’t been returned this fee. We understand no one wants to lose money but as previously stated the fee is taken in the understanding that it would become forfeit in such circumstances to protect the vendor, who additionally for your own situation has been very accommodating throughout.

Tenant Fees

Current Tenancies & Company lets Signed Before 1st June 2019

All fees include VAT:

Renewal fee: £180

New Assured Shorthold Tenancies (ASTs) Signed On or After 1st June 2019

Holding Deposit (per tenancy)

One Week’s rent. This is to reserve a property and will be offset against 1st months Rental. Please note: This will be withheld if any relevant person (including any guarantor(s)) withdraw from the tenancy, fail a Right-to-Rent check, provide materially significant false or misleading information, or fail to sign their tenancy agreement (and/or Deed of Guarantee) within 15 calendar days (or other Deadline for Agreement as mutually agreed in writing).

Security Deposit (per tenancy. Rent under £50,000 per year)

Five weeks’ rent. This covers damages or defaults on the part of the tenant during the tenancy.

Unpaid Rent

Interest at 3% above the Bank of England Base Rate from Rent Due Date until paid in order to pursue non-payment of rent. Please Note: This will not be levied until the rent is more than 14 days in arrears.

Lost Key(s) or other Security Device(s)

Tenants are liable to the actual cost of replacing any lost key(s) or other security device(s). If the loss results in locks needing to be changed, the actual costs of a locksmith, new lock and replacement keys for the tenant, landlord any other persons requiring keys will be charged to the tenant. If extra costs are incurred there will be a charge of £15 per hour (inc. VAT) for the time taken replacing lost key(s) or other security device(s).

Variation of Contract (Tenant’s Request)

£50 (inc. VAT) per agreed variation. To cover the costs associated with taking landlord’s instructions as well as the preparation and execution of new legal documents.

Change of Sharer (Tenant’s Request)

£50 (inc. VAT) per replacement tenant or any reasonable costs incurred if higher. To cover the costs associated with taking landlord’s instructions, new tenant referencing and Right-to-Rent checks, deposit registration as well as the preparation and execution of new legal documents.

Early Termination (Tenant’s Request)

Should the tenant wish to leave their contract early, they shall be liable to the landlord’s costs in re-letting the property as well as all rent due under the tenancy until the start date of the replacement tenancy. These costs will be no more than the maximum amount of rent outstanding on the tenancy.
