I had an offer accepted on a property in Hove through Fox & Sons. It was for a 2 bedroom property that I was told had just come back on the market after a previous buyer from Scotland had run in to difficulty with their finances.
While the transaction was progressed quickly I grew increasingly concerned by the seller not providing a copy of the original lease (it was a Share of Freehold) - weirdly they had provided copies of two amendments to the lease, but not the original. I had lined up a mortgage, but did not want to spend good money on surveys until I had seen the lease.
**** and ** seemed fine with me requesting this until after four weeks they told me that (all of a sudden) the seller had had second thoughts. This was conveyed to me by email, at 8pm on a Friday. I was really upset and quite angry that they did not have the good manners to call me and explain the situation.
I decided to head down from London to the property the following morning, and by chance was able to bump into the seller outside the property. We had a calm conversation. The seller said that I really should speak to ****. I asked whether they were pulling out of selling or whether they had found a different buyer. He said the latter.
After this I headed to Fox and Sons and saw **. While she sympathised with my situation, her (and ****'s) feedback was that this was my fault for not progressing with a survey. The idea that this was a bit risky without seeing the original lease made no sense to them. Pity they didn't say this earlier...
Lastly, I asked what the sellers intentions were. ** said they wanted to reflect on the situation and were not minded to go through with any sale. Looking on Rightmove I have now learned that the sale was completed not long after this debacle.
To make matters worse, they knew that I was renting, and given their previous encouragement about how keen the seller was to complete (given the early offer having fallen through) I had handed my notice in on my tenancy.
I strongly suspect that I was gazumped. While Fox and Sons would have made very little financial gain out of this, they certainly could have managed their relationship with me better and helped ensure the original lease was forwarded to move the transaction forward. Their cowardly means of communicating was the final straw.
I would advise all buyers to be cautious when using Fox and Sons in Hove.
