Not sure if this is ethical or even legal as there's no clear instruction for buyers as if you don't come to an agreement to purchase it with the auction, you as a buyer ...
We like to offer a transparent service and ensure customers are provided with enough information to make an informed choice. This includes providing Seller/Buyer guides, access to our Terms and Conditions of auction, preparation of Buyer Information Packs, explanations of the bidding process and our fees; along with case studies, FAQ's and access to independent customer reviews.
Due to this transparency, a prudent Buyer then has enough information regarding the process, and the property, to either carry out further due diligence or proceed to purchase.
The Buyer pays a non-refundable Reservation Fee to reserve the property from sale. Whilst we appreciate you may feel this fee to be exorbitant, there are benefits to both Sellers and Buyers on choosing to purchase a property via the Modern Method of Auction.
Unlike the open market/private treaty, the Modern Method of Auction provides the speed and security of a property sale that cannot be offered via the open market. Realistic, yet fixed timescales are set from the start to ensure the process runs as smoothly and as quickly as possible, to timeframes that benefit all.
There is an exhaustive list of unforeseen reasons, or anything outside of your control, for why a property sale may not conclude; however, following our advice, transparency, our process and acting as a prudent Buyer who has carried out their own due diligence in regard to the property, i.e. Home Buyer Reports, surveys, viewing the Buyer Information Pack (or referring said pack to a conveyancer) before bidding would make it very unlikely for a property sale not to conclude. Anything highlighted from your due diligence before bidding can be discussed with us beforehand, and we could seek remedy, e.g. by providing a caveat to protect your non-refundable fee in certain circumstances.
