Martyn Gerrard have been operating in the North West London area since the 1960's. They still employ the unscrupulous dirty tricks that were part and parcel of the estate agency business in the latter part of the last century.
Be VERY careful when entering into a Marketing Agreement with them. The will look to lock you in to to what amounts to a âSole Selling Rightsâ contract and include terms such as âReady, Willing and Ableâ which means if the agent finds a buyer who fulfils that condition, even if the seller refuses to conclude the sale or withdraws the property before exchange of contracts for whatever reason, the seller is liable to pay commission.
The Marketing Agreement is sent as an email link to facilitate electronic signing. However when attempting to open the agreement a failure message is displayed and you are invited to by Martyn Gerrard to attend the branch office to sign in person. When attending you will be pressured into signing without carefully reading and considering the T&C's within. Beware of this tactic and refuse to sign at the office. Take the agreement away and very carefully read and consider the content and what it is you are letting yourself in for. Does not make for pleasant reading.
Even after the contract comes to an end, there is small print imbedded in the lengthy contract that implies that should you sell via another agent of even by finding your own buyer they will come after you for the commission and they will fabricate documentation to back up their claim.
Martyn Gerrard will ignore your instructions should such instruction not be in their interest. If the seller is not resident in the property they more often than not fail to inform the seller of a viewing. Should the seller complain about the lack of communication, their sales negotiators will invent an excuse blaming the âcomputer systemâ or likewise.
Martyn Gerrard are a relic of a bygone era â the bad old days of estate agency practices. It is time they went the way of the dinosaurs.
