Vendor Fees
1. Our agreed sale commission will be in the sum of 1% + vat of achieved Sale Price (Subject to a minimum of £800 + vat). Set up fee of £150 + vat. These fees are inclusive of all our costs including advertising expenses, the costs for Sale Boards, photographs etc. There will normally be no charge in the above fees other than in the following instances.
2. I/We confirm that no other Estate Agent shall be instructed in the sale without prior consultation with and the consent of and Movenowsales Limited reserve the right to amend their terms and conditions of sale if it is agreed to instruct another Agency along with ourselves, details of which will be confirmed in writing by us at that time.
3. If it is discovered that other Agents have been appointed without our consent, Movenowsales Limited reserve the right to terminate this Agreement immediately, without serving any Notice and in these circumstances, will charge you a flat rate fee of £100 + vat, being a contribution towards the costs of valuing and advertising the property.
4. If we have introduced Purchasers to your property and you decide not to sell, we will charge you a Withdrawal Fee of the full commission due.
5. If you decide to take your property off the open market within the initial 12 week period, Movenowsales Limited reserve the right to charge a fee of £100 + vat being a contribution towards the costs of valuing your property, the preparation of particulars, and advertising the property.
6. It should be clearly understood that Movenowsales Limited will normally offer all parties concerned in the sale its full range of Estate Agency Services which may incorporate Selling your Buyer’s property, and selling Financial Services without any obligation on any part to take up these services.
7. Section 21 of the Estate Agency Act 1979, requires us to declare a Personal Interest if any member of the partnership or staff of Movenowsales Limited is related to the seller of the property. If you are aware of such a relationship with any of our staff, please advise us accordingly.
8. Legal requirements have become far more stringent in the respect of the accuracy and content of the Sales Particulars that are prepared. A copy of the draft sales particulars will be provided for your consideration. Great care should be taken when confirming the substance and accuracy of these details in general and particularly when confirming the accuracy of the Tenure of the property, room dimensions etc. You should also advise us if any rooms (such as loft conversions) should have had Planning Consent or Building Regulation approval, but have not, or any Planning matter, as we may then have to amend our Particulars accordingly. You should also at the same time advise us if there are any problems arising or anything which could adversely affect the property, in order that all parties are aware of any such circumstances at the outset. If there are therefore any amendments or inaccuracies that need correcting, you must advise us in writing.
9. All offers received on your property, will be communicated in writing until such time as you authorise us to accept an offer, and you can expect to receive these communications in due course.
10. DATA PROTECTION ACT 1998 The vendor authorises the Estate Agent and Property Portal Provider of which it is a member to process their personal information for the purposes of providing services associated with the business of an estate agent but specifically excluding mailings and promotions by a third party.
11. It is now a legal requirement to have an EPC (Energy Performance Certificate) prior to marketing. If your property requires an EPC we can arrange this for you at a cost of £79.17 + vat.
12. I/We acknowledge receipt of the Terms of Engagement Contract and accept its conditions and conform that the draft particulars enclosed herewith are correct. Please note that all authorised sellers (or their properly appointed representatives) must sign this Agreement.
13. From instructing us verbally or in writing you have a 14-day cooling off period which begins the day after you enter this contract.
14. We accept no liability or responsibility for the maintenance or repair of, or for any damage to, the property at any time. If the property is vacant when adverse weather conditions are likely, frost damage may occur to water and heating systems and sanitary appliances. We recommend you take all necessary action to protect your property from such risks and to ensure that the property has adequate insurance cover.
Landlord Fees
Find a tenant only: Set up fee £180 including VAT (£150+vat) (One off payment, not charged on reoccurring find a tenant only services)Payable each time a new tenant is found and moved in £450 including VAT (£375+vat)

Tenant Fees
PERMITTED PAYMENTS
" Rent - Agreed prior to the start if the tenancy
" Pet Rent - To be agreed with the landlord, generally an additional £40 per month
" Deposit - A Refundable Deposit. Equivalent to 5 weeks rent. Funds will be claimed from your Deposit if applicable at the end of your tenancy.
" Reposit Insurance - An optional alternative to paying a deposit. Movenowproperties may receive a referral fee for any insurance agreed.
" A reservation fee of £98.07 (1 Weeks Rent) This maybe retained under any of the following circumstances:
1) You decide not to proceed with the property for any reason.
2) Your application process fails due to incomplete or inaccurate information provided in the tenancy application. This also includes failing the right to rent check, employment check, accommodation reference or credit checks.
3) You do not respond with all the relevant documents and signed the tenancy agreement within 15 days of paying the reservation deposit.
" Insurance - Any insurance taken out with our recommend insurance broker may result in Movenowproperties receiving a referral fee.
" Tenant Shop - An optional service whereby tenantshop notifies the local council, water and energy suppliers of your move. Tenantshop may offer a referral fee to ourselves for any products taken out by you. The reverse will happen when you move out.
DEFAULT FEES
" Rent Arrears - You will be charged 3% above basic bank of England base rate for any late rent. To be charged on day 14 of being in arrears.
" Lost Keys / Fobs - You will be charge £50 including VAT for any replacement keys or fobs. Additional fees may apply under extreme circumstances
" Surrender of Tenancy - If you wish to break your tenancy agreement and your landlord agrees, you will be charged £420 including VAT to surrender your tenancy.
" Novation of Contract - If you wish to change your contract, for instance, introducing a pet, decorating or change of rent date, there will be an administration fee of £50 including VAT, per change, subject to your landlord agreeing to the changes.
