I don't know where to begin, and although I (luckily) am not with this 'estate agents' any longer, friends of friends ask me for advice due to me being vocal and passionate about the treatment we received from this business towards myself and my three flatmates, for almost two years.
From workmen walking in my bedroom unannounced and shouting 'for fuck sake' after finding me asleep, to our deposits being handled illegally- this business is an absolute disgrace and as a result, our landlord decided to remove them from 'managing' the flat I rent and many others under their ownership to a more friendly, efficient, professional and legitimate estate agents instead, and rightly so.
I feel that the treatment towards students is disgusting for several reasons, and therefore students should look out for various issues in which I shall address: Check your inventory, we discovered that the inventory claimed we had a toaster, a microwave, a working hoover, a working oven and mattresses in a decent condition. (There was no toaster, microwave, working Hoover, working cooker and the springs in the bed were visibly rising from the material- the inventory had clearly been made up or copy and pasted from the year before).
Work men would walk in to the flat unannounced- particularly at the beginning of the tennency- who were rude and disgusted that we were unaware that they were coming- yet we were rarely made aware by Cairn.
When the lease ended for my first property with Cairn (unfortunately we had signed a lease for a second before encountering such following issues with them during our time in the next flat), Cairn attempted to charge us over £500 for cleaning costs and for leaving things in the property that belonged to ourselves. Despite the fact we were not invited to a check out inspection which is what a professional letting agency should do, the said cleaning costs were for things such as 'streaks on the kettle', we were happy to pay a reasonable fee as expected for them to cover their professional clean ready for the next tenant's, yet their fees were a joke. They claimed that two bedrooms needed re-painting and that it is up to the landlord to decide when this shall be and so it would be difficult for them to provide us with a receipt of the paint purchased and proof of the job being done after we asked for them to provide us with a quote and evidence that this is what our money would go on. This is actually illegal. In addition, had we had been invited to the check-out inspection, we would have made sure they were checking their inventory properly as the things we had apparently left that they claimed belonged to us, were actually originally in the flat to begin with- such as a mirror and mattress protectors etc.
Most importantly tonne aware of is the illegal handling our deposit. After enquiring to Safe Deposit Scotland about our deposit (due to Cairn refusing to give it us back due to refusing to pay the fees, and from a lack of communication from them for over two weeks), Safe Deposit Scotland informed us that our deposit was safe, yet was entered three months after our lease began. This means that our deposit was more than likely sat in a high interest bank account for Cairn to make money off, before they secured it like they should do by law. This is illegal and after threatening with action against the Landlord (as the landlord is the only party who can be made accountable for this by law as advised by a solicitor and the ombudsman), Cairn very quickly gave us every single penny back of our deposits, and luckily we only had to endure a few more months of them before another agency took over managing our property.
Students watch out, but remember you can always win your case if you do your research like I did, especially when they avoid the law.
