I am a Landlord Investor and have bought a number of properties over the years. I have dealt with many agents during this time. Sanderson James however will be crossed off my list for future though.
I bought a property in April 2015. I got the mortgage arranged, survey, solicitors organised, etc. Firstly, Sanderson James initially denied a survey had even been done. I had left it with the mortgage company to contact them, so I was surprised to hear this, as my broker had previously told me the survey had been instructed. It turned out this was false. In fact, we were waiting for the valuation report to come back. Only a few days later I received the report and the mortgage offer.
It was then time to instruct my solicitor to do the searches, etc.
Then stage 2 from Sanderson James. Now they told me exchange had to take place within 14 days. This was 3 days after I got the survey report back. The solicitor would have had my paperwork for 24 hours at most at this point. My solicitor confirmed this would be impossible, as the average time is 6-8 weeks, which is about right as that is how long I have expected things to take with all other properties I have bought. By the time all the paperwork has been done, searches, etc, this all takes time, so that would be a fair estimate. Sanderson James however decided that was far too long. They told me there was another interested party. This despite the property being on the market for 9 months, and if I couldn't exchange within the 14 days the vendor would pull the contract.
Sanderson James told me they had sent emails to my solicitor and not had responses. What kind of responses they were hoping for, I don't know, as it was not yet time for them to get involved as I hadn't had the survey report back. No buyer will instruct a solicitor to begin work, thus incurring fees, without the survey report. What if there was a problem with the property? Then you lose a survey fee AND search fees.
I have found out the vendor is in fact one of the associates of Sanderson James. So what is going on? Well it appears to me as though they were playing me to try and increase my offer. That was never going to happen! So I am now left £365 out of pocket through this appalling situation. Reading the comments on here it looks like I am not the first person this has happened to. I only wish I'd read these comments first before buying (or trying to buy) this property.
Another theory could be they were wanting me to use their solicitors instead of my own. I got a quote from them which was too expensive so I went with my own. Sorry, but I choose which solicitors I use thank you very much, nobody else.
There are no winners apart from the survey company here. I have already complained to Sanderson James, and spoken to the area manager by phone. I am not at all happy with what she said, so I will now be taking my complaint to the Ombudsman, and going to the small claims court for the £365 I have lost.
I don't think Sanderson James will be in business for much longer, as more and more people become aware of their sharp practices. I have never known any agent behave like this before. Sanderson James will learn now though, I am not one of those cry baby clients who will just roll over and accept this kind of situation. They are the ones in the wrong and I will take action against them.
I would also like to add, I am also a letting client, and they are managing a property of mine. This property will now be withdrawn and managed by another agent. As inconvenient as this is for me, I need to deal with agents I can trust.
What agent could do to change your mind?
Well apart from the ‚£365 I lost which didn't go to them, we didn't actually get that far.
