Hi NM, have you sought solicitor's advice on where you stand with not being made aware that you would have to pay for the HIP if you pulled out? If the paperwork was not available to you beforehand, they are misrepresenting the facts and under contract law both you and your wife would have needed to sign the TOB as joint legal owners for it to be enforceable. So it might be worth asking a solicitor to write a letter for you - sometimes just one letter can be sufficient to prompt a refund. ...

Hi Caroline You may want to make sure about your facts when you post things. Returning a tenant's deposit is not the Estate Agent's call, but the Landlord's. Estate Agents hold deposits as independant stakeholders and can only release it with agreement from both Landlord and Tenant. If you have the wrong end of the stick on this matter, your opinion can hardly be taken seriously and it may be best for you to stay away from these sort of websites. ...

I think Mr Costellos reply in this matter only supports "sam"'s story as it clearly shows a lack of professionalism and disrespect for your clients. How about responding to the actual points she made instead of resorting to personal attacks? Having dealt with Barnard Marcus myself (a different branch however, I should point out) I am gobsmacked about how unprofessional they were. We are using the branch in Barnes (Sales team) and they are not helpful at all. We arranged a second viewing for a particular house we are interested in buying and asked for access to the loft because there were some wet patches on the ceiling. An agent came and first thing she said was that we had 10 minutes to view the house! I spend more time buying a pair of shoes...moreover, she said that there was no ladder to access the loft and the owner was not available. She *kindly* suggested to arra ...
